Terms of use of the guest WiFi of the Town of Weinfelden
1. Service
The Town of Weinfelden (hereinafter "the Town") provides a free public guest WiFi at various locations in Weinfelden. By registering and using the guest WiFi you accept these terms of use.
2. Access
Access requires registration with your first name, last name and mobile number. The mobile number is confirmed with an access code that you receive by SMS. The access code is personal and must not be passed on to third parties. Each access is valid for a limited period, after which you need to log in again.
3. Availability
The Town provides the guest WiFi voluntarily and free of charge. There is no entitlement to availability, a particular bandwidth or a particular quality. The Town may restrict, interrupt or discontinue the service in whole or in part at any time, limit the duration of use and the data volume, and block access to certain services or content.
4. Security
The guest WiFi is a public network. Data you transmit unencrypted can be read by third parties. Only transmit confidential data over encrypted connections, for example https or a VPN. You are responsible for protecting your device, for example with antivirus software, a firewall and current updates.
5. Obligations of users
You are responsible for your use of the guest WiFi and for the content you transmit, and you comply with applicable law. In particular, it is prohibited
• to unlawfully download, distribute or make available copyrighted works, for example via file sharing;
• to access or distribute unlawful, pornographic, violence-glorifying, racist or defamatory content;
• to send spam or other unauthorised advertising;
• to attack networks, systems or data of third parties or to disrupt or overload the guest WiFi;
• to give third parties access or to pass on the guest WiFi commercially.
In the event of violations, the Town may block access without prior notice.
6. Liability
Use is at your own risk. To the extent permitted by law, the Town accepts no liability for damage arising from the use or unavailability of the guest WiFi, in particular for data loss, damage to devices or malware. Liability for intent and gross negligence remains reserved.
You indemnify the Town against claims by third parties arising from unlawful use by you or from a breach of these terms of use.
7. Data processing
To identify users and to fulfil legal obligations, the Town processes your first name, last name, mobile number, the device identifier (MAC address), the access point used and the time and duration of logins. The data is stored in Switzerland, is not used for advertising and is only disclosed to authorities where the Town is legally obliged to do so. It is deleted automatically after 180 days. Further information can be found in the privacy notice.
8. Changes
The Town may amend these terms of use at any time. The version published at the time of login applies.
9. Applicable law
Swiss law applies. The place of jurisdiction is Weinfelden, unless the law provides otherwise.
In case of discrepancies, the German version prevails.
